Booking Terms

1. Fees

1.1 The fees for any of my (Dan Summers) courses or guided runs do not include VAT. 
1.2 To guarantee a place on any course or guided run you must email me to reserve your space and pay the fee in advance. Your space will only be guaranteed when I have received payment. 
1.3 I accept payment by bank transfer (details provided when you reserve your space by email), cash or cheque.  
 
2. Cancellation by client

2.1 Any changes or cancellations by you will need to be given to me in writing or by email.  
2.2 If you cancel a course or guided run I will try to fill the space and refund you any fees you have paid. If I am not able to fill the space then I will refund 50% of any fees paid if you cancel at least 2 weeks before, 75% between 2 days and 2 weeks before and no refund will be available if you cancel less than 2 days before the start of the course or guided run. 

3. Cancellation by us

3.1 I will endeavour to run all courses and guided runs as planned. However for operational reasons I may have to cancel/amend your booking.
3.2 In the event of cancellation of any booking by me, I will offer you a refund of any fees paid. 

4. General

4.1 You will be asked to provide me with information concerning your participation in the activities you have signed up for and emergency contact detail prior to your course or guided run starting.
4.2 My courses and guided runs are designed for adults. However, I will consider accepting someone who is under 18 years of age if accompanied by a parent or guardian. Please contact me for more information about this and to discuss whether this would be appropriate. 
4.3 All course participants are advised to take out appropriate cancellation, curtailment and accident insurance.
4.4 Please make sure that you have read the details of the course and believe that you will be able to participate in it before booking. If you have any questions or concerns about the course/guided run or your ability to participate in it then please contact me – it is your responsibility to be informed about what you are undertaking.
4.5 I accept no liability for the consequences of strikes, riots, acts of war or terrorism, disease outbreaks, government intervention, natural disasters or adverse weather conditions. If such occurrences cause me to have to cancel a course or guided run I will offer an alternative course or guided run if possible, but accept no liability for return of fees paid prior to cancellation or curtailment.
4.6 If you have a complaint about the service you receive at any point from me please tell me as soon as possible. That way I can try to put things right.
4.7 Making your booking implies that you understand and accept these booking conditions and agree to abide by them.

5. Your data

5.1 I do not sell, rent or lease customer information to third parties.
5.2 I may use photography and video content taken during my courses or guided runs on my social media sites. 
5.3 Please see my Privacy Policy (below) setting out how I will keep and use your data. 

6. Safety

6.1 My courses and guided runs are planned and run in a way designed to manage the risk of accident to both clients and to me, while at the same time providing the best experience I can offer.
6.2 Running off road contains an inherent a degree of hazard and risk and despite taking care accidents may still occur. Trips, falls, scratches and bruises are a normal party of running off road and may occur at any time. 
6.3 All participants in my courses and guided runs should be aware that involvement places them at risk of accident and potential injury, possibly serious or even fatal. By enrolling on one of my courses or guided runs you are confirming that you are aware of and accept the inherent risk associated with participating in my course. You confirm that you will not hold me responsible for any injury, loss or damage to you or your property that you suffer on the course, except for if it is caused by my negligence. 
6.4 I am responsible for your safety during the time you are participating in the course or guided run. In order to manage the risks you must tell me if you are unhappy or feel the activity is beyond your ability. 
6.5 You must tell me if you have any medical conditions that may affect your ability to participate in my courses or guided runs or may compromise your (or the group’s) safety whilst on the activity. 
6.6 The weather conditions may determine that what I can do on any course or guided run. I will work to achieve the objective of the course or guided run within the confines dictated by the weather. I reserve the right amend any aspect of the course or guided run because of the weather.  
6.7 I will be using reasonable endeavours to assess your ability to participate in the activities planned throughout the course. I will attempt to accommodate all abilities and attitudes but there may be times when I determine that someone’s ability or attitude is unsuitable for the training I am proposing. In that situation I may decide that someone cannot participate in the course or guided run as planned. In this situation I will attempt to offer alternative training or may (in my discretion) offer a refund of any fees paid.  
6.8 In order for everyone participating in the course or guided run to be safe, you agree to following all the instructions that I give you.

You must be physically fit for the course.

These terms and conditions will not affect your statutory rights. 


Privacy Policy

Introduction

This Privacy Policy outlines what I will do with the information you send me via my website ("Site"), or when you otherwise share personal information with me.  It does not apply to any other websites or ways you hare your information. 

Grounds for data collection 

Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter "Personal Information") is necessary for me to provide you with the services I offer and answer any questions you have about these services (this equates to fulfilling your legitimate interests and fulfilling contractual obligations).

What and how I collect information?

I only collect Personal Information about you that you have voluntarily provided to me (either by the website or otherwise)
We collect information when you voluntarily submit it to me via the website or otherwise. 

How I will use the information I collect about you. 

I will only use the Personal Information I collect in order to facilitate your participation in the services I am offering and you sign up to. 

However, I may disclose information if I have good reason to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce the agreement between us; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise my rights to defend against legal claims; (v) prevent harm to the rights, property or safety of me, you or anyone else; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

User Rights

You may request to: 
  1. Receive confirmation as to whether or not personal information concerning you is being processed, and access your stored personal information, together with supplementary information. 
  2. Receive a copy of personal information you directly volunteer to me in a structured, commonly used and machine-readable format. 
  3. Request rectification of your personal information that is in my control.
  4. Request erasure of your personal information. 
  5. Object to the processing of personal information by me
  6. Request to restrict processing of your personal information by me.
  7. Lodge a complaint with a supervisory authority.

However, please note that these rights are not absolute, and may be subject to my own legitimate interests and regulatory requirements.

Retention

I will retain your personal information for as long as necessary to provide the services, and as necessary to comply with my legal obligations, resolve disputes, and enforce my policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, I will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 

I may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

Cookies

This website uses some cookies when you submit an enquiry and/or use the website.  

A "cookie" is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. How do we safeguard your information?

I will store all your Personal Information securely whether it is submitted electronically or in hard copy.  Electronic information will be stored on the "Outlook" Microsoft email servers (through my email address dansummersrunning@hotmail.com) and hard copy information will be stored securely at my home. 

Minors

I understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children. Under no circumstances shall we allow use of our services by minors. We do not knowingly collect Personal Information from minors. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at dansummersrunning@hotmail.com.

Updates or amendments to this Privacy Policy

I reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on my website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
